Terms of service

INTRODUCTION

These terms and conditions apply to all persons who purchase any of the products sold by Cook4Life (Pty) Ltd. (Registration No. 2012/007290/07) (VAT No. 4090255698) (“Cook4Life”) set out in one of the product lines attached to the order form, by means of a Cook4Life Pay-as-you-Get U-Choose Agreement.


2. PAY-AS-YOU-GET AGREEMENT

2.1. For purposes of these terms and conditions, a Pay-as-you-Get U-Choose Agreement means an agreement in terms of which Cook4Life allows the Customer to:

2.1.1. Buy any one or combination of the Cook4Life products listed in this order form; any combination of products, bought will be invoiced sequentially (lowest to highest) in terms of value.

2.1.2. pay the minimum monthly instalment of R380 (Three Hundred and Eighty Rand) in respect of the products bought; and

2.1.3. pay the total purchase price in respect of the products bought over a maximum payment period of 18 (eighteen) months.

2.2. The Customer is not required to pay any deposit, or interest when buying the products through a Pay-as-you-Get U-Choose Agreement.

2.3. Each product/s bought under a Pay-as-you-Get Agreement constitutes an individual transaction and Cook4Life will issue a separate invoice in respect of each product/s bought by the Customer.


3. PAYMENT TERMS

3.1. The Customer agrees to pay a minimum monthly instalment towards the total purchase price of the products bought. This minimum monthly instalment shall be calculated as the total purchase price for the products bought, divided by 18 (eighteen) months or R380 (Three Hundred and Eighty Rand), whichever is greater.

3.2. The monthly instalments paid by the Customer shall be allocated sequentially (i.e. all payments will be allocated to the invoice issued first in time until such invoice is settled, and thereafter the monthly instalments will be allocated to the invoice issued next in time, which procedure shall continue until all the invoices are settled).

3.3. All invoices must be settled within 6 (six) months from the date that such invoice is first issued.

3.4. Should the customer fail to settle the total contract amount within the stipulated period as determined in 2.1.3, Cook4Life, at its sole discretion, may add a surcharge of R350 (Three Hundred and Fifty Rand) Inc. VAT which will be payable before the goods are delivered.

3.5. The Customer authorises Stratcol (Pty) Ltd. or such other debit order agent as may be appointed by Cook4Life, to collect all payments due to Cook4Life by way of a debit order.

3.6. The Customer hereby authorises Cook4Life to track debit order dates with available funds at no additional cost to themselves.

3.7. The Customer hereby authorises Cook4Life to make use of the tracking facility as provided for in the Electronic Debit Order (EDO) system at no additional cost to themselves.

3.8. Payments by debit order will be debited from the Customer’s bank account on the Customer nominated salary date of each month. If this date falls on a Saturday, Sunday or officially recognised public holiday in South Africa then the Customer’s bank account will be debited on the preceding business day. Notwithstanding the aforesaid, during the month of December the Customer shall ensure that it has sufficient funds in its bank account to facilitate payment of the monthly debit order for the month of December before, but no later than the 20th of December.

3.9. The Customer’s debit order instructions to its bankers shall remain valid and in effect until all of the Customer’s payment obligations under these terms and conditions have been complied with, or until so cancelled by the Customer. When cancelling any debit order the Customer shall inform Cook4Life telephonically within 11 (eleven) days that such cancellation is made. The Customer shall also provide Cook4Life with a written notice confirming cancellation of the debit order, which notice shall be sent to Cook4Life by prepaid registered post, or delivered to the address set out on Cook4Life’s order form.

3.10. Cancellation of a debit order authorisation by the Customer will not discharge the Customer from his/her obligations towards Cook4Life pursuant to the provisions of these terms and conditions and the Customer shall continue to be liable for the monthly instalments until same have been settled in total against any goods delivered, but not paid for.

3.11. Cook4Life acknowledge that all payment instructions issued by you, the Customer, shall be treated by our bank as if the instructions had been issued by you personally.

3.12. The name that will appear on your bank statement next to the deduction will be COOK4LIFE.

4. DISCOUNTS AND PROMOTIONAL OFFERS

4.1 Vouchers are non-refundable and cannot be exchanged for cash in part or full and is valid for a single transaction only. Vouchers are not valid during sale or in conjunction with any special promotion. Vouchers are not applicable for online purchases and are only valid and redeemable during a presentation.

4.2 A discount will only be awarded when a customer purchases for the minimum amount as determined by the voucher.


5. VAT

“VAT” means value-added tax chargeable under the Value-Added Tax Act 89 of 1991.The purchase price of the goods include VAT at the current rate of tax; and if, at any time before the full purchase price of the goods is paid by the customer, the VAT rate is changed in relation to the supply of the goods and/or services, Cook4Life will be entitled to recover the VAT increase from the Customer prior to delivery of the goods and/or services.


6. MONTHLY SERVICE FEE:

Cook4Life shall be entitled to charge the customer a monthly service fee (MSF) of currently R17.95 VAT incl., for services rendered and will be recovered from the monthly amount payable. This service fee will be reviewed annually.


7. WARRANTY OF PRODUCTS

7.1. Cook4Life may in its sole discretion choose to either replace or repair any faulty products that are still under warranty. If the warranty has lapsed, any repairs or replacements of faulty products will be for the Customer’s account. The Customer is responsible for delivering any faulty product to the nearest Cook4Life branch.

7.2. If selected the customer agrees to the terms and conditions on our extended warranties.


8. DELIVERY OWNERSHIP AND RISK

8.1. Cook4Life will only deliver the product once the invoice in respect of such product is settled. The delivery will be to the address provided by the Customer in the order form. Cook4Life’s delivery days are from Monday to Friday between 08h00 – 17h00. The Customer shall be liable for any fees that may be charged if no-one was available at the delivery address to receive delivery of the Customer’s order.

8.2. Ownership of a product shall pass to the Customer upon settlement by the Customer of the invoice in respect of such product. Risk in respect of the product ordered and paid for shall pass to the Customer once the product is delivered.

8.3 If a staff member of the family signs for the goods being delivered at the delivery address, then such signature shall be as if the customer has signed.


9. PRODUCT DISCLAIMER

Due to ongoing product improvements, Cook4life reserves the right to deliver a similar product to that which was presented to the customer at the time of entering into this agreement.


10. CANCELLATIONS

10.1. All requests for cancellations of an order shall be made in writing and sent either via electronic mail to Cook4Life’s electronic mail address, or by normal post to Cook4Life’s physical or postal address set out on the order form.

10.2. If a product is yet to be delivered at the time that a cancellation request is made, Cook4Life will refund the Customer within 60 days all monthly instalments paid by the Customer towards such undelivered product, provided that Cook4Life reserves the right to levy a 1% (one percent) cancellation fee on the total contract amount.

10.3. Cook4Life reserves the right to refund Customers by way of products to the value of payments received in lieu of a cash refund.


11. COMMUNICATION

The Customer agrees that Cook4Life may process the Customer’s personal information for such purposes allowed for in terms of the Protection of Personal Information Act, 2013.


12. BENEFICIARY

In the event of the Customer passing away, the beneficiary nominated in the order form shall be entitled to all of the deceased Customer’s rights and privileges under these terms and conditions, provided that such beneficiary provide Cook4Life with a valid death certificate in respect of the deceased client, as well as proof of identity.
